The program is designed to operate with little or no financial commitment by the patent owner. KapelisIP’s commercial compensation and Avantech Law’s legal fees are payable from a financial recovery under separately agreed arrangements. Where necessary, third-party litigation funding is sought to cover external litigation costs.
This model enables patent owners to develop potential enforcement opportunities without building an internal enforcement team or committing substantial upfront capital. Its implementation depends on the suitability of the matter and the agreed legal and funding arrangements.
Active Development of Selected Patent Assets
The client designates selected patents for inclusion in the program for an agreed term. KapelisIP receives a priority mandate to identify and commercially assess potential U.S. enforcement opportunities involving those patents and coordinate their development with Avantech Law.
The program can include:
- Reviewing selected patent assets and identifying potential commercial targets.
- Organizing and developing relevant technical and commercial information.
- Coordinating independent legal evaluation and case development with Avantech.
- Identifying potential litigation funding and other risk-sharing arrangements.
- Supporting the patent owner’s commercial decisions as opportunities develop.
The outcome is a prioritized view of potential enforcement opportunities and a coordinated path for developing suitable matters toward enforcement-related licensing, negotiated resolution, or litigation.
Financing and Compensation
KapelisIP’s commercial compensation and Avantech Law’s legal fees are established under separate arrangements with the patent owner. Any third-party funding arrangement is separately evaluated and documented among the relevant parties.
The applicable agreements define fees, responsibility for costs, and the allocation of any financial recovery.
Targeted Patent Enforcement Assessment & Management
A focused service for patent owners who already have a particular patent, patent family, product, or potential infringer in mind.
KapelisIP assesses whether the identified opportunity warrants further development as a potential U.S. enforcement matter. We help organize relevant technical and commercial information and coordinate independent evaluation with appropriate U.S. litigation counsel.
If the opportunity appears commercially viable, we coordinate the next stage of evaluation and case development and, where relevant, discussions with potential litigation funders.
The outcome is a practical assessment of the opportunity, the information still needed, and recommended next steps. The scope and financial terms of this service are agreed separately for each engagement.
