Targeted Patent Enforcement Assessment & Management is a flexible, case-specific service for patent owners that already have a particular patent, patent family, product or potential infringer in mind. It is designed to determine whether the specific opportunity warrants further development as a ptoential U.S. enforcement matter. If the opportunity appears commercially viable, KapelisIP coordinates the next state of evaluation and case development with appropriate U.S. litigation counsel and, where relevant, potential litigation funders.
KapelisIP US Patent Enforcement Management™ is a strategic program for patent owners that want a group of patent assets to be actively assessed and developed for potential U.S. enforcement opportunities. The client designates defined patents for inclusion in the program for an agreed term. KapelisIP receives a priority mandate to identify and commercially assess potential US enforcement opportunities involving those patents and to coordinate their development with Avantech Law, LLP, an independent U.S. law firm that specializes in patent litigation.
Where appropriate, KapelisIP may also identified or propose potential third-party litigation funding sources to finance eligible litigation costs. Any funding arrangement is separately evaluated and documented among the relevant parties.
KapelisIP‘s commercial compensation and Avantech Law’s legal fees are established under separate arrangements with the patent owner and are subject to applicable law and professional obligations. The program is designed to operate with little or no financial commitment by the patent owner. KapelisIP‘s compensation and Avantech Law’s legal fees are payable from a financial recovery, and, where necessary, third-party litigation funding is used to cover external litigation costs.
